Albuquerque Bitcoin, Crypto ATM Ban Takes Effect With $500 Daily Fines

Albuquerque's ban on crypto ATMs and cashier-facilitated cryptocurrency transactions has taken effect, with daily files for violators. Albuquerque, New Mexico, has implemented a new Virtual Currency Ordinance that requires businesses operating or hosting cryptocurrency ATMs to immediately remove these machines. The deadline is Dec. 5, giving operators 45 days to remove the kiosks. The restrictions cover physical kiosks and in-person payments collected by cashiers on behalf of cryptocurrency providers. Residents retain the right to own, possess, mine, and privately transfer cryptocurrency through internet-based exchanges and personal digital wallets. The U.S. Commodity Futures Trading Commission (CFTC) has reported over $388 million in reported losses during 2025. Arizona has implemented reimbursement requirements for fraudulently induced transactions involving customers who had been with an operator for fewer than 10 days. Federal lawmakers also introduced the Stop Crypto ATM Scams Act, which would establish transaction limits, scam warnings, disclosures, and recordkeeping requirements.
